Judicial Philosophy
— Carmen J. DeFranco
"My vision for the 51st District Court is simple: it should be the Court of the People. The district court is where most citizens will have their first and maybe only direct interaction with the judicial system. Whether someone enters the courthouse as a victim, witness, defendant, juror, attorney, or even as a concerned citizen, they deserve to be treated with dignity, courtesy, and respect. A courtroom should never be a place where people feel ignored, intimidated, or unheard. It should be a place where every individual is confident that they will receive a fair hearing and that their concerns will be considered thoughtfully and impartially.
"I believe that equal access to justice is one of the cornerstones of a strong judicial system. The courts must be accessible to all members of our community regardless of their financial circumstances, background, race, gender, or personal beliefs. Every person who appears before the court should know that they will be judged by the facts, the law, and the merits of their case, not by who they are or where they come from. As a judge, I will work diligently to ensure that all who enter the courtroom are treated fairly and have a meaningful opportunity to be heard.
"Respect for the rule of law must remain at the heart of every judicial decision. Judges are not elected to advance political agendas or personal viewpoints; they are entrusted with the responsibility of faithfully applying the law. My commitment is to follow the law as written, without regard to political pressure, partisan interests, or public opinion. The integrity of our justice system depends on judges who are independent, impartial, and willing to make decisions based solely on the facts and the law before them. The rule of law is what ensures fairness, consistency, and public confidence in our courts, and it must always remain above politics.
"I also believe strongly in the important role that treatment courts and Veteran’s courts play within our justice system. Throughout my career, I have seen firsthand how these specialized programs can transform lives while still maintaining accountability. Treatment courts recognize that many individuals who enter the criminal justice system are struggling with addiction, mental health challenges, or other underlying issues that contribute to criminal behavior. Veteran’s courts acknowledge the unique sacrifices and challenges faced by those who have served our nation and have suffered trauma or developed addiction as a result. These programs provide structure, accountability, treatment, and support, offering participants an opportunity to change the trajectory of their lives while making our community safer. As a judge, I will continue to support and champion programs that balance accountability with rehabilitation and provide deserving individuals with a meaningful opportunity for success.
"Ultimately, my goal is to ensure that the 51st District Court is a place where justice is administered fairly, the law is applied impartially, victims are heard, defendants are treated with dignity, and every member of our community can have confidence in the judicial process. By combining experience, integrity, and dedication to public service, I hope to foster a court that reflects the very best ideals of our legal system and our community."
